Accidents with Public Vehicles (Texas Tort Claims Act)
If you are involved in an accident with a Texas state or city vehicle, it is important that you secure legal representation from Jim S. Adler & Associates immediately. Governmental agencies in general have immunities to lawsuits, and until the 1970's when the Texas Tort Claims Act (TTCA) took effect, they could not be sued for any reason no matter how negligently they or their employees acted.
The TTCA made some exceptions to this rule of "sovereign immunity" including a section called "Liability For Operation Or Use Of Motor-Driven Vehicle Or Motor-Driven Equipment." This section states that: "A governmental entity is liable for the property damage, personal injury and wrongful death resulting from the negligent operation or use of a motor-driven vehicle or motor-driven equipment."
However, the TTCA does not make it easy to sue the government. There are many hoops to jump through before the case can go to court including filing the suit within a certain time period and applying for "permission" to seek compensation. Even if the preliminaries are successfully won, there are many rules and pitfalls to negotiate around when bringing your case to court, and you must strictly adhere to the terms of the Act.
Also, there may be other legal considerations involved. For example, if a private company is under contract to or is working on behalf of a governmental agency, the agency may inaccurately claim that the company is not liable for any damages done to you or your vehicle. This could cause delays to your case, restrict the amount of compensation payable, and ultimately could affect your rights to any claims.
That's why it is so important to get Jim S. Adler & Associates on your side as quickly as possible. We have over 30 years of experience with personal injury law including helping victims faced with medical bills, lost work, and mental anguish due to the negligence of city and state employees. We know how to use the TTCA to get the highest compensation owed to you to cover these losses.
